These Terms and Conditions apply to your access to and use of adftestprep.com and any products or services we provide through the site. By accessing or using the site, creating an account, or purchasing a product, you agree to these Terms.
1. About ADF Test Prep
ADF Test Prep provides independent preparation resources for candidates. We are not endorsed by, affiliated with, or connected to the Australian Defence Force, and we do not guarantee selection, employment, or outcomes in the ADF recruitment process.
2. Eligibility and Accounts
You must be at least 16 years of age to purchase or access our products. If you are under 18, you confirm that you have obtained parental or guardian consent to use this site and make purchases.
You must provide accurate information when creating an account or making a purchase. You are responsible for maintaining the confidentiality of your login details and all activities under your account.
We may suspend or terminate access if we reasonably believe:
• your account is being used fraudulently
• you are sharing access improperly
• you are breaching these Terms
3. Products, Access and Delivery
We provide digital products and services, including practice tests and preparation materials. Products are delivered via third-party platforms including FlexiQuiz. Access is subject to the continued availability of those platforms. In the event of a third-party platform outage or discontinuation, we will make reasonable efforts to restore or transfer access but cannot guarantee uninterrupted delivery.
Access periods, inclusions and usage limits are described on the product pages at the time of purchase. It is your responsibility to review product details before buying.
Where a product includes a specified access period (for example, 12 months), access will expire at the end of that period. Your account data and progress may not be retained after expiry. We are not obligated to provide ongoing access once the stated access period has ended.
We may update, improve or change content over time. Any changes are intended to enhance the service and do not create an obligation to maintain the exact same content indefinitely.
4. Third-Party Content
Some content on this site may include material sourced from third parties, including publicly available resources published by the Australian Government and the Department of Defence. Where third-party content is used, it is attributed where appropriate and used for educational purposes only. ADF Test Prep does not claim ownership of third-party content and does not represent that such content is endorsed by the original publisher.
5. Pricing and Payments
Prices are shown on the site in AUD and are inclusive of any applicable taxes unless otherwise stated. Payment processing is handled by third-party payment providers. If a payment fails or is reversed, we may suspend access until payment is resolved.
6. Refunds and Consumer Guarantees
Australian Consumer Law may provide consumer guarantees that cannot be excluded.
To the extent permitted by law, and except where required by Australian Consumer Law, purchases of digital products are generally non-refundable once access has been provided. If you believe you have a legitimate issue, contact adftestprep@gmail.com with your order details and we will review your request.
7. Communications and Email
By purchasing a product or creating an account, you may receive transactional emails related to your purchase and account. With your separate consent, you may also receive marketing communications including product updates and preparation tips. You may unsubscribe from marketing emails at any time by clicking the unsubscribe link in any email or by contacting us at adftestprep@gmail.com. We comply with the Australian Spam Act 2003.
8. Acceptable Use
You agree not to:
• misuse the site or interfere with its operation
• attempt to access areas you are not authorised to access
• distribute malware or engage in harmful conduct
• share, resell, or redistribute paid content or login access
• scrape or copy questions or explanations for reuse elsewhere
• use the site in a way that infringes intellectual property rights
9. Intellectual Property
All intellectual property rights in the site and content remain with ADF Test Prep or licensors. Your purchase grants you a limited, personal, non-transferable licence to access the content for your own preparation use during the access period.
10. Disclaimer
The site content is general information and study preparation only. It is not official ADF recruiting advice and may not reflect the most current recruiting requirements. You should confirm official requirements via ADF Careers and related official channels.
We do not warrant that the site will be uninterrupted or error-free.
11. Limitation of Liability
To the extent permitted by law, we are not liable for any indirect or consequential loss, loss of profits, loss of data, or business interruption arising from your use of the site or services.
Where liability cannot be excluded, our liability is limited to the extent permitted by law, and may be limited to resupplying the services or the cost of resupply.
Physical training and water activity disclaimer: ADF Test Prep content may include guidance relating to physical training, running, swimming, underwater swimming, deep-water activities, and water-confidence exercises for preparation purposes only. This content is not medical advice, not professional coaching, and not a substitute for qualified instruction, lifeguard supervision, or medical clearance. Swimming and underwater activities carry inherent risks including serious injury or death. You are solely responsible for your training decisions, physical condition, safety, and the environment in which you train. You should seek medical clearance before undertaking any physical training program and should never train in water without appropriate supervision. To the maximum extent permitted by law, ADF Test Prep accepts no responsibility or liability for any injury, illness, death, loss, damage, or claim of any kind arising from participation in or reliance on any physical exercise, swim training, underwater activity, deep-water activity, or other physical task referred to or described in our content.
12. Force Majeure
We are not liable for any failure or delay in providing access to our products or services caused by circumstances beyond our reasonable control, including but not limited to platform outages, third-party service failures, internet disruptions, natural disasters, or government actions.
13. Privacy
Our Privacy Policy explains how we handle personal information and forms part of these Terms.
14. Changes to the Site and Terms
We may change, suspend or discontinue any part of the site at any time. We may update these Terms by posting an updated version on the site. Continued use after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria.
16. Severability
If any provision of these Terms is invalid, illegal or unenforceable, the remaining provisions remain in effect.
